This website is operated by ESR Collective, the apparel line of Eagle Sports Range in Cudahy, Wisconsin. Throughout the site, the terms "we", "us" and "our" refer to ESR Collective. ESR Collective offers this website, including all information, tools and services available from it, to you, the user, on the condition that you accept all of the terms, conditions, policies and notices stated here.

By visiting our site or buying something from us, you use our "Service" and agree to be bound by these Terms of Service ("Terms"), including any additional terms, conditions and policies referenced here or available by hyperlink, such as our Refund Policy, Shipping Policy and Privacy Policy. These Terms apply to all users of the site, including browsers, customers, merchants and contributors of content.

Please read these Terms carefully before using our website. If you don't agree to all of them, you may not access the website or use any Service.

Any new features or tools added to the current store are also subject to these Terms. You can review the most current version at any time on this page. We may update, change or replace any part of these Terms by posting updates to our website. It is your responsibility to check this page periodically. Our store is hosted on Shopify Inc. Shopify provides the online e-commerce platform that lets us sell our products to you.

Section 1: Online Store Terms

By agreeing to these Terms, you confirm that you are at least the age of majority in your state or province of residence, or that you are the age of majority and have given consent for any minor dependents in your household to use this site.

You may not use our products for any illegal or unauthorized purpose, and in using the Service you may not violate any laws in your jurisdiction, including copyright laws.

You must not transmit any worms, viruses or code of a destructive nature.

Breaching any of these Terms will result in immediate termination of your Services.

Section 2: General Conditions

We reserve the right to refuse service to anyone, for any reason, at any time.

Your content, not including credit card information, may be transferred unencrypted and may involve (a) transmission over various networks and (b) changes to conform and adapt to the technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, access to the Service, or any contact on the website through which the Service is provided, without our express written permission.

Headings in these Terms are for convenience only and do not limit or otherwise affect these Terms.

Section 3: Accuracy, Completeness and Timeliness of Information

We are not responsible if information on this site is inaccurate, incomplete or out of date. Material on this site is provided for general information only and should not be relied on as the sole basis for decisions without consulting more accurate, complete or timely sources.

This site may contain historical information that is not current and is provided for reference only. We may modify the contents of this site at any time but have no obligation to update any information on it. You agree that it is your responsibility to monitor changes to our site.

Section 4: Modifications to the Service and Prices

Prices for our products are subject to change without notice.

We may modify or discontinue the Service, or any part or content of it, at any time without notice.

We are not liable to you or any third party for any modification, price change, suspension or discontinuance of the Service.

Section 5: Products, Limited Drops and Pre-Orders

Limited drops. Most ESR Collective products are released in small, limited runs ("drops"). Quantities are limited and available while supplies last. A sold-out design may not be restocked, and when it's gone, it's gone. Drop dates and times announced on our site, email or social media are targets and may change.

Order limits. We may limit quantities per person, household or order, and may cancel orders that appear to have been placed by resellers, automated tools (bots) or anyone trying to get around a purchase limit. If we cancel an order you have already paid for, we will refund the full amount to the original payment method.

Pre-orders. Some products may be offered as pre-orders. A pre-order product page will show an expected ship window. Ship dates are estimates and may change because of production or supplier delays, and we will contact you at the email on your order if a pre-order is delayed. Pre-order items are final sale, except when an item arrives damaged or incorrect (see our Refund Policy).

Product details and sizing. Our tees are printed on unisex relaxed-fit blanks (currently Comfort Colors 1717 heavyweight garment-dyed cotton). Garment-dyed fabric varies slightly in color from piece to piece and batch to batch, and cotton may shrink slightly. Measurements in our size chart are approximate (about ±1–2 inches). We make every effort to show product colors and images accurately, but we cannot guarantee that your screen will display any color accurately.

Stickers. Stickers are intended for clean, smooth surfaces. We are not responsible for damage to surfaces caused by applying or removing a sticker.

Designs and humor. Our graphics, including range-culture, firearm-themed and humor designs, are artistic and novelty works. They are not endorsements by, or affiliated with, any manufacturer, brand or organization unless we say so.

We may limit sales of our products to any person, geographic region or jurisdiction, case by case. We may change product descriptions or prices at any time without notice. We may discontinue any product at any time. Any offer for any product made on this site is void where prohibited.

We do not warrant that the quality of any products, information or other material you purchase or obtain will meet your expectations, or that any errors in the Service will be corrected.

Section 6: Accuracy of Billing and Account Information

We may refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, or orders that use the same billing or shipping address. If we change or cancel an order, we will try to notify you by contacting the email, billing address or phone number provided at the time the order was made.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Section 7: Shipping and Delivery

Our Shipping Policy is part of these Terms. In summary:

• Orders are processed within 1–2 business days (pre-orders ship within the window shown on the product page) and are shipped via USPS.
• U.S. orders under $100 are charged $9.99 flat-rate standard shipping. U.S. orders of $100 and over ship free.
• We ship throughout the United States. International orders are welcome. Shipping is calculated by destination and may be confirmed before the order is fulfilled. International customers are responsible for any duties, taxes or customs fees charged by the destination country.

Delivery times are estimates from the carrier and are not guaranteed. Risk of loss passes to you when the order is handed to the carrier. If a package is lost or arrives damaged, contact us and we'll help you file a claim with the carrier and make it right.

Section 8: Returns, Exchanges and Refunds

Our Refund Policy is part of these Terms. In summary:

• Items may be returned or exchanged within 30 days of delivery if they are unworn, unwashed and in their original condition. To start a return, contact us through our Contact page or at shop@eaglesportsrange.com with your order number.
• Return shipping is the customer's responsibility unless the item arrived damaged or incorrect, in which case we cover return shipping.
• Approved refunds are issued to the original payment method within 5–10 business days after we receive the return.
• Sale and pre-order items are final sale, except when an item arrives damaged or incorrect.

If these Terms and the Refund Policy or Shipping Policy ever conflict, the specific policy controls.

Section 9: Optional Tools

We may give you access to third-party tools that we neither monitor nor have any control or input over.

You acknowledge and agree that we provide access to such tools "as is" and "as available", without any warranties, representations or conditions of any kind and without any endorsement. We have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use of optional tools offered through the site is entirely at your risk and discretion, and you should make sure you are familiar with and approve of the terms on which the relevant third-party provider(s) offer the tools.

We may also offer new services or features through the website in the future, including new tools and resources. Such new features and services are also subject to these Terms.

Certain content, products and services available through our Service may include material from third parties, such as our Instagram (@esrcollective) and other social media.

Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating their content or accuracy, and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products or services of third parties.

We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content or any other transactions made in connection with any third-party websites. Please review the third party's policies and practices carefully and make sure you understand them before you engage in any transaction. Complaints, claims, concerns or questions about third-party products should be directed to the third party.

Section 11: Reviews, Comments, Feedback and Other Submissions

If you send product reviews (including through our review app), photos, comments, creative ideas, suggestions, proposals or other materials, whether online, by email, on social media or otherwise (collectively, "comments"), you agree that we may, at any time and without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments you send us. We are under no obligation (1) to keep any comments confidential, (2) to pay compensation for any comments, or (3) to respond to any comments. We will ask before featuring a customer photo that shows your face.

We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable, or that violates any party's intellectual property or these Terms.

You agree that your comments will not violate any right of any third party, including copyright, trademark, privacy, personality or other personal or proprietary rights. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or any computer virus or other malware that could affect the operation of the Service or any related website. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third parties about the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third party.

All designs, graphics, logos (including the ESR Collective and ESR Co marks), text, photos and other content on this site are owned by ESR Collective or used with permission and are protected by copyright, trademark and other laws. You may not copy, reproduce, print, sell or otherwise use our designs or content for any commercial purpose without our written permission. Buying a product does not give you any right to reproduce its design.

Your submission of personal information through the store is governed by our Privacy Policy.

Section 14: Errors, Inaccuracies and Omissions

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We may correct any errors, inaccuracies or omissions, and may change or update information or cancel orders if any information in the Service or on any related website is inaccurate, at any time without prior notice, including after you have submitted your order.

We have no obligation to update, amend or clarify information in the Service or on any related website, including pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website should be taken to indicate that all information in the Service or on any related website has been modified or updated.

In no case shall ESR Collective, Eagle Sports Range, or our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special or consequential damages of any kind, including lost profits, lost revenue, lost savings, loss of data, replacement costs or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products bought through the Service, or for any other claim related in any way to your use of the Service or any product, including any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted or otherwise made available through the Service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in those states or jurisdictions our liability is limited to the maximum extent permitted by law. These Terms are effective unless and until terminated by you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use our Services, or when you stop using our site.

If, in our sole judgment, you fail, or we suspect that you have failed, to comply with any term or provision of these Terms, we may also terminate this agreement at any time without notice. You will remain liable for all amounts due up to and including the date of termination, and we may deny you access to our Services (or any part of them).

Any dispute will be brought in the state or federal courts located in Milwaukee County, Wisconsin.
